1. Definitions
In these Terms and Conditions, the following definitions apply:
"Service" refers to the website leonardoopitz.com and all mobile applications developed and published by Leonardo Opitz, including but not limited to MoodDoodle, PFM (Personal Finance Manager), PI, and MyBestPlaces.
"User," "You," "Your" refers to any individual who accesses or uses our Service.
"We," "Us," "Our" refers to Leonardo Opitz, the owner and operator of the Service.
"Content" refers to text, images, data, drawings, or other materials uploaded, submitted, or displayed through the Service.
"Application" or "App" refers to any mobile application developed by Leonardo Opitz and distributed through the Apple App Store, Google Play Store, or other platforms.
"Third-Party Services" refers to external services, APIs, or platforms that may be integrated with or linked from our Service.
2. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Service.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
These Terms apply to all visitors, users, and others who access or use the Service, including the website and all mobile applications. By downloading, installing, or using any of our Applications, you also agree to these Terms.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Use License
Permission is granted to temporarily access and use the Service for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Use the materials for any commercial purpose or for any public display;

4. Mobile Applications
Our mobile Applications are made available for download through third-party app stores (Apple App Store, Google Play Store). Your use of the Applications is also subject to the terms and conditions of the respective app store.
You acknowledge that these Terms are between you and Leonardo Opitz only, and not with Apple, Google, or any other app store provider. Leonardo Opitz, not the app store, is solely responsible for the Applications and their content.
The Applications are licensed, not sold, to you. Your license to each Application is subject to your prior acceptance of these Terms and any additional terms within the Application itself.
We reserve the right to modify, update, or discontinue any Application at any time without prior notice. We are not obligated to provide any maintenance or support services for the Applications.
You are responsible for ensuring that your device meets the minimum requirements for running our Applications and for keeping your device's operating system updated.
5. User Accounts and Content
Some features of the Service may require you to create an account or provide personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when creating an account or submitting data through the Service. You must promptly update your information if it changes.
You retain ownership of any Content you create or upload through the Service. However, by submitting Content, you grant Leonardo Opitz a non-exclusive, worldwide, royalty-free license to use, store, and process your Content solely for the purpose of providing and improving the Service.
You are solely responsible for the Content you submit through the Service. You agree not to submit Content that is illegal, offensive, defamatory, or infringes on the rights of others.
We reserve the right to remove any Content that violates these Terms or that we deem inappropriate, without prior notice.
6. In-App Purchases and Subscriptions
Some of our Applications may offer in-app purchases or subscription services. All purchases are processed through the respective app store (Apple App Store or Google Play Store) and are subject to their payment terms and policies.
Subscription services automatically renew unless cancelled before the end of the current billing period. You can manage and cancel your subscriptions through your app store account settings.
Prices for in-app purchases and subscriptions are subject to change. We will notify users of any price changes through the app store or within the Application.
Refunds for in-app purchases and subscriptions are handled by the respective app store in accordance with their refund policies. Leonardo Opitz does not directly process payments or issue refunds.
Free trial periods, if offered, will automatically convert to paid subscriptions unless cancelled before the trial period expires.
7. Disclaimer
The materials and services provided through the Service are offered on an "as is" and "as available" basis. Leonardo Opitz makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Leonardo Opitz does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.
Any data stored locally on your device through our Applications (including journal entries, financial records, or other personal data) is your responsibility to back up. Leonardo Opitz is not responsible for any data loss resulting from device failure, app updates, or uninstallation.
The Service may contain links to third-party websites or services that are not owned or controlled by Leonardo Opitz. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
8. Limitations
In no event shall Leonardo Opitz or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if Leonardo Opitz or an authorized representative has been notified orally or in writing of the possibility of such damage.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid to Leonardo Opitz in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.
Leonardo Opitz shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government actions, or failures of third-party services.
9. Accuracy of Materials
The materials appearing on the Service could include technical, typographical, or photographic errors. Leonardo Opitz does not warrant that any of the materials on the Service are accurate, complete, or current.
Leonardo Opitz may make changes to the materials contained on the Service at any time without notice. However, Leonardo Opitz does not make any commitment to update the materials.
Information provided through the Service, including but not limited to motivational content, financial summaries, or statistical data, is for informational purposes only and should not be construed as professional advice.
You acknowledge that any reliance on materials, information, or content provided through the Service is at your own risk.
10. Modifications
Leonardo Opitz may revise these Terms and Conditions at any time without prior notice. By continuing to use the Service after such revisions are posted, you agree to be bound by the revised Terms.
We may also modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content, without prior notice or liability.
If we make material changes to these Terms, we will make reasonable efforts to notify you, such as by posting a notice on the website or within the Application. However, it is your responsibility to review these Terms periodically.
Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
For users within the European Union, nothing in these Terms affects your rights under applicable EU consumer protection legislation, including the right to seek resolution through the European Online Dispute Resolution platform (ODR) at https://ec.europa.eu/consumers/odr.
